ASBSometimes your witness statement will be accepted by the defendant’s (perpetrator) solicitor and you may not be asked to attend court to give evidence.

If you are required to attend Court, you will be required to go in to the witness box and swear on an oath, that what you will say “will be the truth”. If you do not have a religious belief, you can affirm your evidence. The Court Usher will provide you with a card to read the appropriate words from, whether you swear on oath or affirm.

You will be asked questions mainly by the defendant’s (perpetrator) solicitor. You might also be asked questions by the Magistrates’ or a Judge. They will not be permitted to shout or intimidate you. They may ask you challenging questions about what has happened.

You may bring someone for support with you to the Court. The ASB Team can seek permission from the Court Staff for them to stay with you throughout proceedings.

You will receive support at Court before and after the hearing from the ASB Case Manager, as well as other support agencies that have been identified.
