The ASB Case Manager will keep you informed of the progress of your case on a regular basis.
If non-legal measures fail to stop the ASB, enforcement action through the Court may be necessary. If this is necessary, you will be asked to provide a witness statement. The statement itself will detail the incidents of ASB and how it has affected you.
The ASB Case Manager will arrange for your statement to be taken by a Police Officer, at a time and location that is convenient for you. The Police Officer will ensure that the statement is an accurate record and you are comfortable with what it says before you are asked to sign it.
This statement will form part of Torbay Council’s complaint against the defendant(s) and you may be asked to go to Court to give oral evidence on what you have said in your statement.
The ASB Case Manager will provide you with a copy of your signed statement.
We will consult with you before using your statement in other proceedings.
